French Competition Authority Fines Apple €150 Million for Anti-Competitive ATT Practices

The French Competition Authority imposed a €150 million fine on Apple for abusing its dominant position in mobile app distribution through discriminatory implementation of its App Tracking Transparency framework between April 2021 and July 2023. The decision found that Apple’s implementation created artificially complex user experiences while initially exempting Apple’s own apps from the same requirements. Significantly, the full Decision 25-D-02 cites the study by Aridor, Che, Hollenbeck, Kaiser, and McCarthy, which provided comprehensive evidence of ATT’s substantial revenue declines for e-commerce firms, particularly smaller companies highly dependent on Meta advertising.
